टिपिएस् हुनेले सिटिजनशीप पाउन सक्ने

मेरिल्यान्डका दुई जना डेमोक्रेटिक सिनेटर बेन बार्डिन र कृश भ्यान होलेनले ९ फेब्रुअरी २०२१ मा सिनेटमा द सेक्युर एक्ट पुनः प्रवेश गराए । यो त्यस्तो कानुनको मस्यौदा हो जुन पारित भए अमेरिकामा टेम्पोरेरी प्रोटेक्टेड स्टाटस (टिपिएस्) मा रहेका आप्रवासीले ग्रिन कार्ड र अन्ततः सिटिजनशीपका लागि आवेदन दिन सक्छ ।

यसमा भएका प्रावधान अनुसार टिपिएस् सुविधामा अमेरिकामा रहेकाहरूले ग्रिन कार्ड प्राप्त गर्न विभिन्न तथ्यहरू प्रमाणित गर्नु पर्छ । एक जना योग्य कानुन व्यवसायीले तपाईँ ग्रिन कार्ड प्राप्त गर्न योग्य हुनुहुन्छ कि हुनुहुन्न भन्ने यकिन गर्न सक्छ । वर्तमान अवस्थामा नेपालीका लागि अक्टोबर २०२१ सम्म टिपिएस् अवधि लम्बाइएको छ । तर, यो सेक्युर एक्ट पारित हुनसक्ने सम्भावना मध्यनजर गर्दै टिपिएस् सुविधामा रहेकाहरूले ग्रिन कार्डका लागि आवेदन गर्न तयारी गर्नै पर्छ ।

अमेरिकामा करिब १५ हजार नेपाली टिपिएस् सुविधामा रहेका छन् । टिपिएस् अमेरिकाले सशस्त्र युद्ध, प्राकृतिक प्रकोप, महामारी वा अन्य असामान्य अवस्थाका कारण आफ्नो देशमा जोखिममा रहेका विदेशी नागरिकलाई संरक्षण दिन अस्थायी रूपमा प्रदान गरेको कानुनी हैसियत हो । हाल एल साल्भाडोर, हैटी, होन्डुरस, नेपाल, निकारागुवा, सोमालिया, सुडान, साउथ सुडान, सिरिया र यमनसहित १० देशका ४ लाख ११ हजार मानिसले टिपिएस् सुविधा पाएका छन् ।

टिपिएस् सुविधा पाएका विदेशी नागरिकले अमेरिकामा वैधानिक रूपमा बस्न र काम गर्न पाउँछन् । तर, प्रशासनमा आउने बदलावसँगै टिपिएस सम्बन्धी दृष्टिकोणमा परिवर्तन हुने गरेको छ । हरेक ६ देखि १८ महिनामा टिपिएस् पुनरावलोकन गरिन्छ । यस्ता कारण टिपिएस् सुविधा पाएका आप्रवासीहरू त्रासमा बाँचिरहनु परेको छ । हरेक ६ देखि १८ महिनामा डिपार्टमेन्ट अफ होमल्याण्ड सेक्युरिटीले टिपिएस् सुविधाको पुनरावलोकन गर्छ । त्यस्तो पुनरावलोकन सम्बन्धित देशको अवस्थामा सुधार भएको छ कि छैन भन्ने आधारमा हुन्छ । त्यस आधारमा डिपार्टमेन्ट अफ होमल्याण्ड सेक्युरिटीले कुन देशको टिपिएस् अवधि थप्ने भन्ने निर्णय गर्छ । हरेक पटक अवधि थपिँदा जुन देशबाट आएर अमेरिकामा टिपिएस् सुविधा पाएको हो, त्यो देशका नागरिकले थप अवधिको टिपिएसका लागि पुनः आवेदन दिनु पर्छ ।

द सेक्युर एक्ट टिपिएस् बाहकको मनबाट भविष्यबारे यस्तो अनिश्चितता हटाउने उद्देश्यले सिनेटमा पुनः लगिएको हो ।

TPS holders may become eligible for U.S. Immigration Attorney Citizenship under Biden Administration

On February 9th, 2021, the two democratic senators from Maryland, Ben Cardin, and Chris Van Hollen reintroduced a bill in the Senate called the The Secure Act which would allow TPS holders to apply for a green card and eventually, U.S. citizenship.

If this bill passes, TPS holders will have to prove several factors to show that they are eligible for a green card. A qualified immigration attorney will be able to determine your eligibility. As of right now, TPS has been extended for Nepal until October of 2021. However, TPS holders need to prepare themselves in case the Secure Act is passed and they become eligible to apply for a green card right away.

Approximately 15,000 Nepali citizens in the United States have TPS status. TPS is a temporary, legal status granted to foreign citizens who are endangered by conditions in their home country such as ongoing armed conflict, environmental disaster, epidemic, or other extraordinary events. Currently, the United States has 411,000 people with TPS designation from ten countries including; El Salvador, Haiti, Honduras, Nepal, Nicaragua, Somalia, Sudan, South Sudan, Syria, and Yemen.

Although the designation of TPS status does allow for the person to legally live and work in the United States, people benefitting from this program live in constant fear of changing administrations’ attitude towards this program as TPS statuses are subject to review every six to eighteen months. Every six to eighteen months, the Department of Homeland Security decides whether it wants to extend TPS or not based on a country’s current conditions. Every time a country is recertified, the TPS holder has to reapply for the status.

The Secure Act was introduced in an attempt to combat this sense of uncertainty that the TPS holders live with every day.
