अदालत बाट “Bhattarai v Nielsen” मुद्दाको वादी र अमेरिकी सरकार बिचको सम्झौता स्वीकृत भएमा जुन २४, २०१९ पछि को समयावधि स्वतः लम्बिने छ र अघिल्लो “Ramos vs Nielsen” मुद्दाको सुनुवाइ को निर्णय नभए सम्म अनिश्चित अवधिको लागि हामी सुरक्षित हुने छौँ।

यस अवस्थाको फाइदा उठाउन अनेक जाल गरी शुल्क लिन खोज्ने कुनै व्यक्ति या अधिवक्ता देखि सावधान रहन पनि यही सूचना मार्फत जानकारी दिन चाहन्छौँ। थप सत्य जानकारी लिन “अधिकार” लाई सम्पर्क गर्नु होला।) नेपाल र होन्डुरस टिपिएस् सम्बन्धी Bhattarai v Neilsen मुद्दामा वादी पक्ष र प्रतिपक्षी अमेरिकी सरकार बिच हाललाई सम्झौता भएको छ। सो सम्झौता बमोजिम नेपाल र होन्डुरसको मुद्दा अधिल्लो मुद्दा Ramos v Nielsen (सुडान, एल साल्भाडोर, हेईटी र निकारागुवा) सँगै निधो गरिने र सो सुन वाई नहुन्जेन नेपाल टिपिएस् पहिले तोकिएको मिति (जुन २४, २०१९) मा अन्त्य गर्न नपाइने भएको छ।

Ramos v Nielsen (साथै हाम्रो Bhattarai v Nielsen) को मुद्दामा प्रतिपक्षी सरकारको उजुरीको सुन वाई कहिले हुँदैछ त?

यो सुनवाईको मिति अहिले सम्म तय भई सकेको छैन। आउँदो गृष्म (summer) या त्यसको केही पछि हुने सम्भावना रहेको अनुमान गरिएको छ। यदि दुवै पक्षले उक्त निर्णयको फेरि उजुरी नगरेमा मुद्दा त्यहीँ अन्त्य हुनेछ।

वैकल्पिक रूपमा, हार खाने पक्षले Ninth Circuit अदालतलाई “en banc”(न्यायाधीश को समूह ) वा सर्वोच्च अदालत रूपमा पुनःसुनवाईको माग राख्न सक्नेछन्। त्यसो भएमा सोही अदालतको बृहत् न्यायाधीश बेन्चले या सर्वोच्च अदालतले सुन वाई गर्नेछन्। त्यस पश्चात् मात्र सो Ninth Circuit अदालत या सर्वोच्चले कि त सुन वाई नगर्ने निर्णय गर्नेछन्, या सुन वाई गरी अन्तिम फैसला जारी गर्नेछन्।

यो सब प्रकियाको समयावधि निश्चित नभए पनि करिब दुई वर्ष सम्म लाग्ने अनुमान गर्न सकिन्छ। पहिलो उजुरीमा हाम्रो पक्षको जित भएमा मुद्दा पुनः District अदालतमा फिर्ता जानेछ र टिपिएस् अन्त हुने मिति हालको लागि स्थगित गरिने छ। हाम्रो पक्ष हारेको खण्डमा अमेरिकी सरकारले टिपिएस् अन्त गर्न थप ६ महिना अनुग्रही अवधि दिनु पर्ने हुन्छ र त्यस पश्चात् टिपिएस् अन्त हुन सक्छ।

अब के गर्ने त?
अमेरिकी सरकारले मे १० (May 10th) को वरिपरि आधिकारिक Federal Notice धोषणा गर्नेछन् होला। तपाईँको टिपिएस् अटोमेटिक (स्वतः) नवीकरण हुनेछ। कुनै दरखास्त दिनु पर्दैन र कुनै शुल्क तिर्नु पर्दैन।

याद गर्नु होला:
हालको लागि कुनै एक्शन (action) लिनु या कुनै कदम चाल्नु पर्दैन। धैर्य पूर्वक हाल जसरी काम गरी रहनु भएको छ र टिपिएस् को सुविधा मार्फत जुन आधारमा रही रहनु भएको छ, निर्धक्क सँग त्यसलाई निरन्तरता दिनु होला। अन्तिम नतिजा जस्तो भए पनि हाललाई जुन २४, २०१९ को समयावधि भने रद्द भएकोले त्यस बारे कुनै पिर गर्नु पर्दैन। हाललाई केही राहत मिलेको छ। तपाईँहरू र हाम्रो समुदायको हितको निम्ति टिपिएस् बारे स्थायी समाधान नहुन्जेन “अधिकार” सँग सहकार्य गर्दै यस अभियानमा ढृडता पूर्वक लागि रहने आश्वासन दिन्छौँ।

BREAKING NEWS: Nepal TPS Lawsuit – Adhikaar Update
*Please read through carefully all the way through.*

Plaintiffs in Bhattarai v. Nielsen have come to an agreement with the U.S. government that, if approved by the court, will mean the government cannot end TPS for Nepal on June 24. Instead, the termination will be on hold until the appeals court decides on Ramos v. Nielsen.

Please remember–there is no need to file anything or pay any fee to benefit from the lawsuit’s protection. Be careful of people or attorneys who may try to benefit unfairly and try to charge you to benefit from the lawsuit!

When will the appeals court decide on Ramos v. Nielsen?

A hearing on the Ramos appeal has not been scheduled yet. It is expected this summer. A decision could come any time after that. If neither side requests more review after the decision, the appeal ends there.

Alternatively, the losing side in the appeal can ask the Ninth Circuit to rehear the case en banc (i.e. with a larger group of judges) or the Supreme Court to hear the case. If that happens, the appeal continues until the Ninth Circuit and/or Supreme Court either refuse to hear the case or agree to hear it and issue a final decision. While there is no set timeline, this process could take up to two years.

If we win the appeal, the terminations will stay on hold while the case goes back to the district court. If we lose the appeal, the government still has to keep Nepal’s TPS in place for at least 6 months. After that, TPS could be ended.

What do I do now?
We are waiting for the government to publish the official Federal Register notice, which is expected around May 10. The renewal will be automatic. There will be no need to pay a fee or file an application.

For now, please wait and continue to work and do everything it is that you normally do. There is no rush to process anything or start any applications. Take this moment to take a deep breath, and know that the government has agreed to provide some temporary relief for our community. We will let you know as soon as the judge approves the agreement.
